Terms of Service

The platform rules in the same structure as “How it works”: clearly navigable, grouped by topic and without hidden sales language.

Scope

Which Permutis surfaces these terms apply to.

  • Provider and contact

    Provider identification, a serviceable address and general contact channels are set out in the legal notice (Impressum). These terms govern the relationship between Permutis as a technical platform and the persons who use the website, web app, mobile apps or connected services.

    Permutis provides features for discovering, initiating, coordinating and documenting swaps. Permutis does not thereby become the owner, a broker in the legal sense or a contracting party to the specific swap between users. Users remain responsible for whether they enter into a swap, which information they exchange and whether their offer is lawful.

  • Covered platform areas

    Covered areas include in particular the website, web app, mobile apps, user account, profile, offer management, swipe discovery, matches, chats, reviews, reports, support, trade-up challenges, Founders and partner features, and optional platform services such as visibility, boosts, AI support and subscriptions.

    Additional terms of individual app stores, payment providers, hosting providers or technical service providers may also apply where users use those services directly. In addition, the privacy policy, cookie policy, community and offer guidelines, challenge rules, Founders Club notices, partner programme rules and specific feature notices form part of the Permutis rules where they are relevant to the respective use.

    In the event of conflicts within Permutis documents, more specific policies for individual features take precedence over general descriptions, provided they do not unfairly disadvantage users. Mandatory statutory rights, consumer rights and data protection rights remain unaffected.

  • Status

    Status: 19 June 2026. These terms describe the use of Permutis as a swap platform: swap instead of buy, no prices between users, no monetary demand for offers, and clear moderation rules.

    Supplementary notices may apply for individual features, in particular for app-store subscriptions, payment providers, withdrawal, cancellation, trade-up challenges, privacy, cookies, the partner programme and support processes.

Eligibility

Who may use Permutis and when an account may be restricted or terminated.

  • Age and legal capacity

    Permutis may only be used by persons who are at least 18 years old and have full legal capacity. Legal entities or organisations may only use Permutis if the acting person is authorised to represent them and all information provided is accurate.

    Permutis is not directed at children. Content, profiles, messages or offers that may endanger, specifically target, sexualise, exploit or place minors in unsafe situations are prohibited and may be removed immediately.

  • Account management and electronic communication

    An account may only be maintained with accurate, up-to-date and personal information. Users must keep their contact address reachable, because legal notices, security alerts, support replies, contractual information and changes may be communicated electronically by email, app, website or in-app messages.

    Users may not operate accounts for suspended persons, create circumvention accounts or use automated access. Permutis may request evidence where verification, suspected abuse, the partner programme, payouts or security checks make this necessary.

  • Suspension, restriction and termination

    Users may close their account using the available features or via support. Open support cases, abuse investigations, statutory retention duties, payment records for platform services or security reasons may require certain data to be retained temporarily.

    Permutis may restrict features, deactivate offers, reduce visibility, suspend or terminate accounts if users breach the law, these Terms, policies, security rules, challenge rules, privacy requirements or the no-money rule. In serious risk cases a measure may take effect immediately; in less serious cases Permutis may first warn or require remediation.

Swap instead of buy

The core principle: Permutis is a swap platform, not a sales platform.

  • Swap logic

    Permutis is designed for swaps. An offer may be a good, a service or a skill. A permitted swap exists where users voluntarily agree to exchange one offer for another offer without one user demanding a price or a monetary payment from the other.

    The platform supports initiation through profiles, offers, categories, swipe decisions, matches and chats. A match only means mutual interest. Whether a swap takes place, which handover method is chosen and whether an offer meets expectations is for the participating users to clarify under their own responsibility.

  • No prices, no purchase prompts

    Users may not set prices for offers, formulate purchase prompts, state sales conditions or demand money. Circumventions are also prohibited, such as “payment only”, external payment links, price lists in images, price statements in chat, “or best offer” wording, or references to external classifieds and shop listings.

    Permutis may technically filter money terms, price terms or buy/sell terms, reject content, deactivate offers, review chats and restrict accounts where such terms are used as an offer condition or sales intent. Mentioning such terms remains permitted in rules, warnings, support cases or legal texts where it is clear that they describe a prohibition or a distinction.

  • Credits are not an offer condition

    Credits are internal platform points and must not be used as a required counter-performance for a user offer. A provider may therefore not state that a good or service will only be swapped for credits. Credits do not replace a real swap and must not be used as a price, substitute currency or mandatory payment between users.

    Outside challenge swaps, credits may only be mentioned or offered voluntarily and without a mandatory condition in addition to a real swap item. They must never be demanded, used as a substitute for a swap offer, or imposed as a condition for completing a swap. For challenge swaps stricter rules apply: no credits, no money, no extra items and no services, where the respective challenge rule so provides.

Account & content

Duties relating to account, security, offers, images and prohibited content.

  • Account and security

    Users must provide accurate, current and complete information where this is required for account, security, swap, verification or support. Access credentials must be kept confidential. Suspicious access, password loss or account misuse should be reported without delay.

    Accounts must not be sold, rented, transferred, created in automated bulk or operated for third parties. Also prohibited are identity deception, false verification, profile imitation, circumvention of a suspension, manipulation of reviews, automated scraping, spam, bot use and any use that impairs the security or availability of the platform.

  • Offers, images and rights

    Users are responsible for the title, description, images, category, condition, availability, collection or handover notes and lawfulness of their offers. An offer must truthfully describe what is actually to be swapped. Defects, limitations, missing accessories, faults, wear or special prerequisites of a service must be stated transparently.

    Titles and descriptions must not contain stealth advertising, affiliate or advertising links, shop links, social-media promotion, spam, keyword stuffing, hidden contact channels, third-party brand advertising without factual relevance, or other activity that does not serve an honest description of the swap item. Links are only permitted where Permutis expressly allows them for a feature or where they are required for security, proof or support.

    Images must show the actual offer or be clearly recognisable as a supplementary illustration. Users may only upload content for which they hold the necessary rights. Third-party product images without permission, stock photos presented as one’s own item, hidden contact information, personal data, watermarks of other platforms or content that infringes third-party rights are not permitted.

  • Prohibited offers

    All offers are prohibited where possession, transfer, advertising, performance or swap is unlawful, unsafe or subject to special permits that the user cannot evidence. This includes in particular illegal goods or services, weapons, ammunition, hazardous substances, drugs, prescription or regulated medical products, counterfeits, stolen goods, personal data, official documents, financial products, cryptocurrencies as swap content, sexual services, hate content, extremist symbols, animal trade, products relevant to species protection and products with safety risks.

    Permutis may block or restrict additional categories where abuse, legal risks, youth protection, product safety, platform integrity or community protection so require. In case of doubt Permutis may request evidence, hide an offer until clarification or remove it permanently.

Matches & swaps

How matches, chats, swaps, challenges and reviews are classified legally.

  • Matches, chats and performance

    A match indicates mutual interest and does not automatically oblige either side to complete a swap. Before handover, users should clarify all material points: condition, scope, accessories, place, time, safety questions, specifics of a service and whether both sides understand expectations the same way.

    For displaying, sorting and recommending possible swap partners, Permutis may use matching signals such as own offers, sought categories, wish lists, swipe decisions, radius, approximate location, language, region, reviews, security status, voluntary profile details such as age group or gender, and cookie and preference data, to the extent their use is permitted under privacy and cookie rules.

    These matching signals serve to produce more relevant suggestions and to increase the chance of suitable swaps. They do not create a right to a particular match, a guarantee of a successful swap, an obligation to accept a suggestion, or a right to disadvantage users on prohibited criteria.

    Permutis provides the technical platform and is not a party to the specific swap between users. Handover is at the users’ own risk. Users should prefer public, safe places, not share sensitive data unnecessarily and use the platform chat so that arrangements remain documented.

  • Trade-up challenges

    Trade-up challenges are a special game mode with additional rules. In Challenge V1 the following applies: exactly one challenge item against exactly one other item, no credits, no money, no extra items and no services. Only completed swaps confirmed by both sides count for progress, ranking or public challenge stories.

    Permutis may review challenge participation, remove invalid steps, correct rankings, exclude users from challenges or withhold stories where manipulation, sham swaps, pressure, impermissible counter-performance, multiple accounts or rule circumvention are apparent.

  • Reviews

    Reviews should help the community identify reliable swap partners. They must be truthful, factual, comprehensible and related to the specific completed swap. Aspects that may be rated include communication, punctuality, condition, handover and overall impression.

    Fake reviews, purchased or coerced reviews, threats, pressure, retaliatory reviews, discriminatory statements, publication of personal data and reviews of events that did not take place are prohibited. Permutis may hide, correct or remove reviews that breach rules or rights.

Platform services

Optional platform services, moderation and staff access.

Paid or credit-based features concern only Permutis itself, not other users’ offers.

  • Subscriptions, add-ons, credits and Founders Club

    Paid or credit-based platform services concern only Permutis features such as visibility, active offer limits, boosts, AI support, credit packs, subscriptions, Founders Club or the partner programme. These services are not a purchase price for user offers and do not create a right that a particular swap will take place.

    For some add-ons, additional digital services may be unlocked with credits, for example visibility, special placements, AI support or other clearly designated platform features. Such add-ons concern exclusively Permutis services and must not be understood as payment to other users.

    The Founders Club is not an investment, not an acquisition of shares, not a security, not an equity interest and contains no guaranteed value growth. Founder benefits are platform benefits whose availability, scope and abuse checks must be specifically described in the respective offer information.

    For subscriptions, digital content, credit packs, boosts or other chargeable platform services, term, renewal, cancellation, withdrawal, immediate performance, app-store processing, payment providers and refund rules are described in the respective offer information. Consumer rights remain unaffected.

    Before taking a paid subscription, users should use the free offering to test core features, offer creation, swap logic and usability. The paid subscription is intended for extended platform features and does not replace users’ own assessment of whether Permutis fits their usage.

  • 14-day withdrawal for subscriptions and digital platform services

    Consumers generally have a statutory right of withdrawal of 14 days from conclusion of the contract for chargeable platform services concluded online, unless a statutory exclusion or an effective early lapse applies. Withdrawal concerns the contract for the platform service, not individual swaps between users.

    As long as a user does not create or activate an offer, does not use subscription benefits, does not spend coins/credits and does not retrieve any other chargeable platform service within the withdrawal period, withdrawal within 14 days of contract conclusion should be possible under the statutory rules.

    If the user expressly requests that Permutis provide the paid platform service immediately during the withdrawal period, and the user confirms that the right of withdrawal may lapse early upon full performance or use of the digital service, the right of withdrawal may lapse as provided by law. Use includes in particular creating or activating an offer under the paid subscription, using increased offer limits, a boost, using purchased coins/credits or retrieving other paid benefits.

    Checkout should present this flow transparently: notice of withdrawal, active consent to immediate performance, confirmation of the possible loss of the right of withdrawal, withdrawal information, model withdrawal form and lasting contract confirmation.

  • Subscription term, renewal and cancellation

    Monthly and annual subscriptions renew for the next billing period if they are not cancelled in time before the next charge, to the extent permitted under applicable consumer law. The concrete term, the next charge date and the cancellation option must be clearly displayed in the account or with the respective app store or payment provider.

    Cancellation should be received no later than 14 days before the next planned charge, whether for a monthly or annual subscription. If cancellation is received after that deadline, the next billing period may become due and cancellation takes effect only at the end of that next period, unless mandatory law provides otherwise.

    Cancellation ends only future renewals. Already due fees, used platform services, consumed coins/credits, boosts, Founders benefits, partner-programme evidence or statutory retention duties remain unaffected. Deleting an account does not replace subscription cancellation where the subscription is managed via Apple, Google, Stripe or another payment provider.

    For consumer subscriptions concluded online, Permutis should provide an easily findable electronic cancellation option. Where a subscription was concluded via an app store, cancellation may additionally or exclusively be required via that app store’s subscription management.

  • Coins, credits and purchase of credit packs

    Coins or credits are internal platform points for Permutis features, for example visibility, boosts, special placements, AI support or other clearly designated platform services. They are not legal tender, not an e-money function, not a balance for user offers, not an investment, not a right to payout, and cannot be exchanged back into money or otherwise claimed as money.

    Coins/credits may be purchased in the shop or earned through platform activities, for example through permitted reviews, successfully completed swaps, successful challenges, bonus campaigns or other activities expressly described by Permutis.

    Coins/credits must never be demanded as mandatory counter-performance for another user’s good or service. A provider may therefore not state that an offer will only be given against coins, credits, money or a combination thereof. Another user may voluntarily offer credits in addition to a real swap item, but the swap must remain negotiable without a mandatory credit demand by the provider. The no-money rule remains fully in force even for purchased or earned credit packs.

    Purchased coins/credits are credited to the account after successful payment confirmation. Upon use for boosts, visibility, AI features or other digital platform services they are considered consumed. Consumed coins/credits are generally not reversed once the service has been technically provided, unless mandatory consumer rights, error corrections or goodwill decisions require otherwise.

    As long as a purchased credit pack has not been credited, not been used and no immediate digital service has been expressly requested within the withdrawal period, consumers may withdraw under the statutory rules. Once the user expressly requests immediate provision, confirms the possible loss of the right of withdrawal and coins/credits are credited or used, the right of withdrawal may lapse early as provided by law.

  • Moderation and reports

    Permutis may review content automatically or manually, restrict or remove it, deactivate offers, hide chats, reduce visibility, warn, suspend or delete accounts where content breaches the law, these terms, community guidelines, security rules or the no-money rule. Users may report suspicious content, messages, profiles or swaps.

    When reviewing, Permutis may consider context such as repetition, severity of the breach, risk to other users, deceptive intent, willingness to cooperate and legal duties. Obviously unlawful or dangerous content may be removed without prior enquiry.

  • Admin and support access

    Support and admin access is purpose-bound, role-based and audit-logged. Access to chats, reports, profile data, offer data or usage data occurs only where required for support, security, moderation, abuse prevention, legal duties, fault analysis or platform operations.

    Permutis should limit internal permissions to what is necessary, log particularly sensitive access and review it regularly. Employees, contractors or agents must not use data privately, for unrelated purposes or outside their role.

Liability & rights

What responsibility Permutis assumes and which rights apply to content.

  • Platform role and liability limits

    Permutis provides a technical platform and does not owe the conclusion, performance, quality or success of a swap between users. Permutis does not generally pre-screen offers and gives no warranty that user statements, identity, availability, condition, rights or performance capability of other users are complete or correct.

    Permutis liability is governed by mandatory law. Liability for slight negligence may, where legally permitted, be limited to breaches of material contractual duties and foreseeable damage. Liability for intent, gross negligence, injury to life, body or health and mandatory statutory claims remains unaffected.

  • Availability, changes and security

    Permutis strives for stable operation but cannot guarantee uninterrupted availability. Maintenance, security measures, technical faults, third-party outages, app-store requirements, abuse prevention or force majeure may temporarily restrict features.

    Permutis may change, remove, limit or further develop features where required for security, legal, product, performance or abuse reasons. For material changes to chargeable platform services, users should be informed appropriately.

  • Rights in user content

    Users retain their rights in images, texts, profile details, reviews and other content, but grant Permutis the rights to store, reproduce, technically adapt, display, translate, moderate and make such content available within the platform to the extent required.

    Users warrant that they hold the necessary rights and do not infringe third-party rights. External advertising, press, social media or public success stories require a separate clearance unless a statutory basis or an already granted specific consent exists.

  • Reporting, reasons and complaints

    Users may report unlawful content, prohibited offers, safety risks, suspected fraud, rights infringements or rule breaches. Permutis should review reports in a comprehensible manner, document appropriate measures and inform affected users of material decisions where required.

    Where features are restricted, accounts suspended or content removed, an appropriate complaint channel should be available where legally required or practically possible. Abusive reports, false complaints or repeated unfounded reports may themselves be treated as a rule breach.

Changes & contact

When these terms may be changed and where further legal texts are found.

  • Changes

    Permutis may change these terms where features, legal requirements, security needs, app-store rules, technical processes or the business model change. Material changes should be communicated transparently, for example via website, app, email or in-app notice.

    Where required by law, changes take effect only after appropriate notice or consent. Already completed swaps remain unaffected by later changes unless mandatory law provides otherwise.

No prices, no monetary demands and no buying/selling between users.
